Buying at an auction can be fun, exciting, and sometimes “frustrating”. Our Buyers’ Guide is a “summary” of our full Terms and Conditions of Sale. It’s intended to make bidding and buying easy and enjoyable. We hope it answers all of your questions and, if not, please read the entire Terms and Conditions of Sale or contact us.

There is no charge for attending our live auctions. However, most of our auctions are online only. We offer previews of all lots offered for sale by appointment.

Bidding at Auction:Bidder approval is at the sole discretion of the Auctioneer. Online bidders must provide a valid credit or debit card to register. You will be liable for any and all bids made via your account. Bidding on items automatically constitutes agreement with Bastute Auctions’ Terms and Conditions of Sale.

Agents:If you intend to bid as an agent on behalf of another party, as a company, or other legal entity, please contact us. Every bidder shall be deemed to act as a principal unless, prior to the commencement of the sale, there is written acceptance by the Auctioneer of a bidder registration form completed and signed by the principal which clearly states that the authorized bidding agent is acting on behalf of the named principal. Absent such written acceptance by the Auctioneer, any person placing a bid as agent on behalf of another (whether or not such person has disclosed that fact or the identity of the principal) may be jointly and severally liable with the principal under any contract resulting from the acceptance of a bid.

Lots are auctioned in consecutive numerical order as they appear in the catalog.  Bidding normally begins below the low estimate, if one is provided.  The Auctioneer (live auctions only) or third-party online bidding platform may also execute bids on behalf of the seller up to the amount of the reserve, but never above it.

The Auctioneers, its agents and employees, shall not be responsible for any problem relating to online bids submitted remotely through any means, including devices or online platforms, including third-party online platforms, regardless of whether such issues arise with our, your, or such third-party’s technology, equipment, or connection.

By participating at an online auction, bidders expressly consent to the recording of their bidding sessions and related communications with the Auctioneer and our agents and employees and acknowledge their acceptance of these Terms and Conditions of Sale as well as any additional terms and conditions applicable to any such bidding platform or technology.

Catalogs:Before each auction, we publish illustrated catalogs online. Our catalogs include photos, descriptions, and may include estimated values for each “lot”. A lot may be a single item or a group of items auctioned together.

Previews:Auction previews are your opportunity to inspect each lot prior to the auction. We encourage you to do so; it is your responsibility to obtain all possible information prior to bidding. Except as expressly set forth in our Terms and Conditions of Sale, all items are sold “As-Is” and with all faults.

Condition reports are available upon request and are strongly recommended if you cannot view the property / lot in person. If you are not completely satisfied with an item / lot before you bid, DO NOT BID.

Photographs and descriptions in our catalogs, website, and other materials are provided for identification only.

All electrical and mechanical items are sold for display purpose only and are sold without guarantee as to the working condition of each lot. Unless specifically illustrated and noted, frames are not included in the estimate or purchase price. We accept no liability for damage or loss to frames, e.g., gesso ones, during storage or shipment.

Estimates:Our catalogs may include low and high value estimates for each lot, excluding the buyer’s premium and sales tax. The estimates are provided as a guide to current market value; they are based on previous auction results for comparable items. They should not be interpreted as a representation or prediction of actual selling prices. They are not an appraisal. They are determined well in advance of a sale and are subject to revision.

Reserves:Unless the sale is advertised and announced as “without reserve”, each lot is offered subject to a reserve. The reserve is the confidential minimum hammer price at which such lot will be sold and it does not exceed the low estimate value for the lot.

Withdrawal:The Auctioneer in its sole and exclusive discretion, reserves the right to withdraw any Property, at any time, before the fall of the hammer.

Auction House’s Interest in Property Offered at Auction:On occasion, Bastute Auctions Incorporated may offer property in which it has an ownership interest in whole or in part or otherwise has an economic interest, e.g., if a buyer defaults or forfeits property.  If the Bastute Auctions has an ownership or equivalent economic interest in an item of property, in whole or in part, that interest shall be disclosed to bidders.

Absentee Bids:Pre-sale / “absentee” bids may be placed on a third-party bidding platform as a “Maximum Bid” that will be automatically executed by the third-party platform. Bids are executed in the order received. (Thus, another bidder may win the lot at your Maximum Bid because it was placed earlier.) It is the buyer’s responsibility to verify the accuracy of the Maximum Bid they are placing before doing so. Bids cannot be retracted by the bidder.

Absentee bids will not be executed on lots found to be other than as described in the catalog unless the Auctioneer or one of its representatives has personally conveyed the updated catalog description to the absentee bidder. The bidder will then have the option of confirming, altering, or canceling the original absentee bid.

Bidding Increments:: Bidding increments for each auction are posted online and in the printed catalog, if one is published. The Auctioneer reserves the right to modify the order, precedence or appropriate increment of bids or the constitution of lots.

Buyer's Premium:A Buyer’s Premium, retained by us and payable by the by you / the buyer, will be calculated based on the hammer price. The Buyer’s Premium will be added to the successful bid price and is payable by the buyer as part of the total purchase price.  Applicable sales taxes are computed based on this figure, and the total becomes your final purchase price.

Payment:PAYMENT FOR EACH INVOICE IS DUE IMMEDIATELY UPON RECEIPT OF THE INVOICE.  Accounts must be settled in full before Property is released to the buyer.  Unless otherwise agreed, payment in good, cleared funds is due and payable within (5) business days following the auction sale.  We reserve the right to refuse to accept payment from a source other than the registered bidder or buyer of record.  Purchases will automatically be posted to the credit or debit card you used to register for an online auction within 72 hours from auction close, unless other payment arrangements have been made and agreed to in writing prior to the date of sale.  If a credit card is used for payment, no chargebacks are allowed for any reason.

Sales Tax:Unless exempted by law from the payment thereof, the buyer will be required to pay any state and / or local sales taxes (or compensating use taxes).  Sales tax will be automatically added to your invoice if we are required to collect and remit sales tax in the subject jurisdiction based on our local nexus and applicable law, unless a valid resale number has been furnished.  If you wish to use your resale license, please contact us directly.

Accidental Loss:If we are prevented by breakage, fire, theft or any other reason whatsoever from delivering any property to the buyer or a sale otherwise cannot be completed, our liability shall be limited to the sum actually paid therefore by the buyer and shall in no event include any compensatory, incidental or consequential damages.

Removal and Storage:Payment is a precondition to removal. Payment will not be deemed to constitute a payment until cleared and good funds received.

Subject to the foregoing, all Property shall be paid for and removed by the buyer at his / her expense within ten (10) days of the date of invoice and, if not so removed, may be sold by the Auctioneer, or sent by the Auctioneer to a public warehouse, at the sole risk and charge of the buyer(s), and the Auctioneer may prohibit the buyer from participating directly or indirectly, as a bidder or buyer in any future sale or sales.

Shipping:The Auctioneer offers shipping services for certain purchased property.  Any shipping services are offered at the buyer’s expense. Buyer may arrange shipping with a third-party shipper.  The Auctioneer is not responsible for any acts or omissions in packing or shipping of purchased lots whether or not such common carrier is recommended by the Auctioneer. Packing and handling of purchased lots of purchased lots is at the responsibility of the buyer and is at the entire risk of the buyer.

Due to excessive fraud, purchases can only be shipped to the individual and billing address on the credit card used for payment. If you wish to have your purchases shipped to a different address, please contact our office. The request may or may not be approved.

Limited Right of Recission:Refunds are given at the sole discretion of the Auctioneer and are limited to lots having major damage or significant restoration / repairs not outlined in the condition report. Please see our full Terms and Conditions of Sale.

Liability:The buyer expressly acknowledges and agrees that in no event shall the Auctioneer be liable for any damages including, without limitation, any compensatory, incidental or consequential damages, In no event shall the aggregate liability of the Auctioneer and its seller to a buyer exceed the purchase price actually paid for a disputed item of Property.
